Amazon Currency Converter™ Terms and Conditions
When you purchase eligible items from the Amazon.co.uk website (the "Site") using a Visa or MasterCard credit card or debit card, Amazon Services Europe SARL ("we", "us", "our") may offer you the choice of paying in the currency that you are billed from your card issuer ("Card Currency") if that currency is other than pound sterling (GBP). You agree to use Amazon Currency Converter on the following terms and conditions, which are separate from and in addition to the Conditions of Use and Sale that govern your use of the Site, including each order that you place:
1. The Amazon Currency Converter only enables you to make payment in the Card Currency. When using Amazon Currency Converter you are not tendering payment in one currency and receiving from us another currency.
2. Before you pay in your Card Currency, you can view the payment total in your Card Currency and the order total in GBP in the “Order Summary” section on the final checkout page on the Site. Where the payment total is displayed in your Card Currency, and you do not wish to use Amazon Currency Converter to pay in your Card Currency, you can click the "Switch Currency" button and choose the "GBP" option to pay in GBP. If you choose to pay in GBP, these terms and conditions do not apply.
3. If you use Amazon Currency Converter to pay in your Card Currency, all fees and charges for your use of Amazon Currency Converter are included in the exchange rate received by us from our bank service provider ("Applicable Exchange Rate"). The Applicable Exchange Rate is determined at the time the payment total is displayed in your Card Currency on the final checkout page on the Site. That payment total will be the amount reflected on your bank or credit card statement. We do not charge any other fees, taxes or other charges for using Amazon Currency Converter. The seller of the items you pay for in your Card Currency will receive payment for those items in GBP as listed on the Site. Your use of Amazon Currency Converter and these terms and conditions are independent of your contract for the purchase of the items from the seller and do not give you any extra rights under that contract. The seller is neither involved in providing the Amazon Currency Converter nor a party to these terms and conditions.
4. If you decide to return an item that you paid for using Amazon Currency Converter for refund or exchange, the same Applicable Exchange Rate will apply to the refund or exchange.
5. The Applicable Exchange Rate only applies at the time of purchase and may change for future purchases. If you cancel an order that you made using Amazon Currency Converter, the Applicable Exchange Rate that applied to that order may not be the same even if you place an identical order at a later date.
6. You can view the Applicable Exchange Rate by clicking the "View Exchange Rate" link while paying using Amazon Currency Converter.
7. You can pay using Amazon Currency Converter on the Site in your Card Currency using a promotional offer or discount.
8. You cannot use Amazon Currency Converter to pay in your Card Currency using an Amazon.co.uk Gift Certificate, Gift Card or Amazon 1-Click, or if any of the eligible items in your order are out of stock or the items are only available for pre-order. Orders for Amazon.co.uk Gift Certificates, Gift Cards and digital items can only be placed and paid for in GBP.
9. If you change an existing order, we will reassess whether the Amazon Currency Converter may be used based on the items, payment method or currency type. If the order is ineligible for payment in your Card Currency, the total amount due will only be displayed in GBP and can only be paid in GBP.
10. You can turn off or opt-out of using Amazon Currency Converter at any time by clicking "Turn on/Turn off Amazon Currency Converter" in the "Payment Settings" section of Your Account. If you have already made a payment using Amazon Currency Converter before turning it off, there is nothing extra that you need to pay when you turn it off, because the Applicable Exchange Rate for each amount that you pay includes all related fees and charges for paying in your Card Currency. Similarly, you would not be due a refund if you were to turn off Amazon Currency Converter after using it to make a payment, because the Applicable Exchange Rate for each payment that you made in your Card Currency included the fees and charges in proportion to the service actually provided by us to you for each payment.
11. These terms and conditions are governed by and construed in accordance with the laws of the Grand Duchy of Luxembourg, and the application of the United Nations Convention on Contracts for the International Sale of Goods is expressly excluded. You agree, as we do, to submit to the non-exclusive jurisdiction of the courts of the district of Luxembourg City.
12. Amazon Services Europe SARL of 5 Rue Plaetis, L-2338 Luxembourg is registered in Luxembourg No. B-93815, Business License Number: 100416, issued by the Ministry of Middle Class Affairs ("Ministère des classes moyennes et du tourisme, Grand-Duché de Luxembourg"),www.mcm.public.lu, Luxembourg VAT Reg. No. LU 19647148. You can contact us about Amazon Currency Converter by visiting www.amazon.co.uk/contactus. There is no specific out-of-court complaint and redress mechanism for Amazon Currency Converter.
13. These terms and conditions are in the English language, and you agree that we may communicate with you in English during the term of this contract.
14. When you visit the Site or send e-mails to us, you are communicating with us electronically. We communicate with you by e-mail or by posting notices on the Site. For contractual purposes, you consent to receive communications from us electronically and you agree that all agreements, notices, disclosures and other communications that we provide to you electronically satisfy any legal requirement that such communications be in writing. This condition does not affect your statutory rights.
15. We reserve the right to make changes to Amazon Currency Converter, our policies, and these terms and conditions at any time. You will be subject to the policies and terms and conditions in force at the time that you use Amazon Currency Converter, unless any change to those policies or these conditions is required to be made by law or government authority (in which case it will apply to orders previously placed by you). If any of these conditions is deemed invalid, void, or for any reason unenforceable by a court, that condition will be deemed severable and will not affect the validity and enforceability of any remaining condition.
